Terms of Use
Effective date: [DATE]
Draft, not yet in effect. Adapted from LighterPack's terms to match how Waymark Gear works. Replace every [bracketed] item, remove this note, and have it reviewed before launch.
Waymark Gear is a free website for planning, weighing and sharing the gear you take on adventures, operated by [OPERATOR NAME]. By using it, you agree to what's below.
See also our Privacy Policy, which covers what we collect and what we do with it.
The short version
Your lists belong to you. Don't use Waymark Gear to spam people or to host things you don't have the right to host. It's free and provided as-is — it's a planning tool, not safety equipment. We can remove accounts that break these rules.
Your account
You need to be 13 or older to create an account.
You're responsible for what happens under your account, so pick a password you don't use anywhere else. Give us an email address that actually reaches you — it's the only way we can help you recover your account.
You can also use Waymark Gear without an account, in which case your lists are stored in your browser rather than on our servers. These terms still apply.
Your content belongs to you
You keep ownership of everything you put into Waymark Gear — your lists, your item descriptions, your photos. We don't claim any of it.
To actually run the service, we need your permission to store your content, display it back to you and to serve it publicly. Creating a list means anyone with the link can view it, embed it in another page, or export it as CSV. That permission lasts as long as the content is on Waymark Gear and ends when you delete it, except that we can't retrieve copies other people have already made.
What you can't do
Don't use Waymark Gear to:
- post spam, including in comments and profile links
- upload images or text you don't have the rights to
- post anything illegal, or anything that harasses or targets another person
- impersonate someone else
- try to access other people's accounts, or probe the site's authentication
- hammer the site with automated traffic, or bulk-scrape lists that aren't yours
- resell access to the service or present it as your own
This isn't a complete list.
Moderation
We can remove content and suspend or delete accounts that break these rules. Anyone can report a comment; moderators review reports and can hide comments. List owners can delete comments on their own lists. Shakedown suggestions are other hikers' opinions, not safety advice: check anything that matters before you rely on it in the backcountry. If you think we've made a mistake, email [CONTACT EMAIL] and we'll take another look. You can delete your own account at any time from Account → Delete account.
Waymark Gear is provided as-is
There's no warranty of any kind. The site may have bugs, and it may be wrong.
In particular: Waymark Gear is a planning tool, not safety equipment. You are responsible for your own gear choices and your own decisions in the field.
No guarantees about availability
Waymark Gear is free. It may go down, change, lose features, or shut down entirely. There's no uptime commitment and no support obligation.
Don't let Waymark Gear be the only copy of anything you'd be upset to lose — you can export any list to CSV at any time.
Affiliate links {#affiliate}
Waymark Gear is paid for partly by affiliate links. When you follow a Buy link to a shop from a gear page, a comparison or a shared list and then buy something, we may earn a commission from that shop. You pay the same price. As an Amazon Associate, [OPERATOR NAME] earns from qualifying purchases.
Commissions never decide what we suggest: lighter options, popular gear and comparisons are ranked by weight, price and how many hikers use an item, and gear without an affiliate deal is treated the same way. Supporters get plain shop links with no affiliate code.
The Supporter plan
Supporter is an optional subscription ([PRICE] a month or [PRICE] a year) that removes affiliate codes from the links you follow and adds a badge to your profile. Everything else on Waymark Gear stays free. Payments are taken and stored by Stripe; we never see your card. The plan renews until you cancel, which you can do at any time from the Supporter page; you keep it until the end of the period you've paid for. [REFUND POLICY, e.g. "If you cancel within 14 days of a payment, email us for a refund."] We may change the price for future periods with at least 30 days' notice by email.
AI assistants and the API
You can connect an AI assistant (through our MCP server) or your own software (through the API) to your account. It acts for you, with the access you chose when you connected it, and these terms apply to what it does. Don't use the API to scrape other people's content or to put a load on the service it can't take; we may limit or revoke tokens that do.
Liability
To the fullest extent the law allows, we aren't liable for any damages arising out of your use of Waymark Gear, including lost data or anything that happens on a trip you planned with it.
The software and the service are different things
Waymark Gear's source code is licensed under the GPL-2.0 (it began as a fork of LighterPack), and that license gives you broad rights to use, modify, and redistribute it. These terms are not about the code — they cover the hosted service at [YOUR DOMAIN].
If you run your own copy, the GPL governs what you can do with the software, and these terms don't apply to your instance. You'll need your own.
Changes to these terms
We may update these terms in the future.
